There is no conviction. This isn't a court case. This all plays back to his character. She did in fact mention brett by name to her therapist in 2012. The whole door thing is secondary - and there is no concrete proof either way what the purpose was. The hard fact is she put herself up for ridicule and now, her life is being threatened. She had nothing to gain, and (for now) has lost everything.
1) I said 'picture yourself on a jury' meaning this is something of a hypothetical. 2) And honestly, it is something of a trial. The witness' are sworn and face charges of perjury so its more a trial than a job interview.
So, based on that, let's continue.
She did in fact mention brett by name to her therapist in 2012. No, we don't know that. What she said was she didn't recall saying his name but said her husband in 2018 said that back in 2012 she said his name. She did not turn over the notes taken by her therapist.
The whole door thing is secondary - and there is no concrete proof either way what the purpose was No, that's been shown to be an absolute fact. She lied about that or at the very least, did not remember the reason or the year it was done. If you remember her testimony however, she was positive about the year and the reason. Hard to believe that was an slip of the memory. And if it was the case she didn't remember correctly, just how seriously can you take her charge that she knew without a doubt it was kavanaugh? Not very.
She had nothing to gain, She was shown to have marched in very strong anti-Trump marches. She donated a fairly large sum to HRC. Kavanaugh's name was mentioned as one of the top 5 BEFORE her letter to DiFi was sent. Being a very strong anti-Trump person and someone who took the steps to protest against Trump, it's likely either she or her like minded friends knew that. Realizing she went to high school near Trump's Supreme Court pick and perhaps even remembered meeting Kavanaugh or perhaps knew people who knew him while they were in high school could have given her the idea to make up a story to discredit him. Being the one to put that much damage to Trump would be a strong motive. To say she had nothing to gain simply isn't true.
Also, since we don't have the therapist notes, we don't know the reason for the couple's session. Personally, i think she got caugh having an affair and a made up story about a sexual assault as a way of explaining away a problem has been done a million times before. Ask the former Governor of Missouri about that one.
The lie about the door is huge as is the lie about fear of flying and not knowing if the lie detector test was done on the day of her grandmother's funeral. Her ex-boyfriend said she helped at least one other person learn about polygraph tests but he didn't testify under oath, at least I don't think he did.
There's just too many red flags for this to add up. She lied about Kavanaugh being the one who assaulted her, perhaps lied about being assaulted at all.
No jury would ever convict Kavanaugh and no grand jury would even indict. Although this will never happen, she could be brought up on perjury charges about the door.
Kavanaugh's behavior to the committee afterwards doesn’t come into play for this mock trial.
