"
Flying is a form of travel.
When did, 'travel', become NOT a 'right' ?"
We had this discussion already. Travel by any and all means possible is not an unalienable right. If this were true the "no-fly list" would have been challenged an revoked 20 years ago. A "form of" anything is not a protected right. A "right" is not without limitations - we have Free Speech but that doesn't mean we can broadcast "Fukk..Fukk...Fukk!" on a loop over the radio, or display pornography films on the side of your house. Laws still apply, restrictions still apply.
Anyone that looks into this would see that the "right" to travel does not and has never meant the means of conveyance by any and all means. It is however three separate "rights":
1:
The right of a citizen to move freely between states.https://www.law.cornell.edu/constitution-conan/amendment-14/section-1/the-rig... Note this is not a Government Funded study. Note it does not say all means of transportation, State and Federal laws apply.
2:
A citizen of one state who is temporarily visiting another state the “Privileges and Immunities” of a citizen of the latter state.
https://www.law.cornell.edu/constitution-conan/amendment-14/section-1/the-rig... Note this is not a Government Funded study.
3:
The right of a new arrival to a state, who establishes citizenship in that state, to enjoy the same rights and benefits as other state citizens.
https://www.law.cornell.edu/constitution/amendmentxiv Note this is not a Government Funded study. It's just the good ol' 14th Amendment.
Before anyone doles out quotes from the The Constitution’s Privileges or Immunities Clause, remember they are focused on entitlements rather than natural rights. Also,
if you actually read it, the more powerful Congress becomes, because of the enforcement rule in Section 5 of the 14th amendment.
Flying in an airplane is not a right.
However my references are actual US law, and US court outcomes which may not be good enough, since they show actual things that actually happen. Perhaps its better to use imagined "rights" where no real life situation supports them ever happening.
