Just curious, what will / could happen over time to an S40 if a HD sportster muffler is installed and the carb in NOT re-jetted?  Does it HAVE to be done?

It depends on the tune of your bike.  
If you're having a lot of backfiring, yes needs another jet.
Follow the tuning guides when ever you change the intake or exhaust.

yes, must rejet on any pipe mod, go Jardine or trap over HD  muffler.  Pay the dollars and do it right. It is your valves and piston!
