Story in college sports about a male swimmer who competed at college level for three years with average results. Senior year, declares himself transgender and now female. Destroying all his female competitors and breaking records by wide margins. Some women swimmers are finally standing up against this.

Question: is there anyone who can offer a defense of why this person should be allowed to compete as a woman?

Dang'it!... I'm agreeing again.
I support bathroom issues etc...   but, in the case of sports, I think trans have an unfair advantage that infringes on the rights of women in sports.

 So it took me a while to get a legal team to look into TITLE IX in regards to women's "rights" to play sports.

 Technically I would say that letting gender identifying female yet biologically born males join in and compete with biologically born females is not a violation of the standards set in TITLE IX as current law is being interpreted.  

 This is because it does not strictly define "male" or "female" thus leaving the door open for gender identity to take the place of biological gender.  

"After considering the text of Title IX, Supreme Court case law, and developing jurisprudence in this area, the Division has determined that the best reading of Title IX’s prohibition on discrimination ‘on the basis of sex’ is that it includes discrimination on the basis of gender identity and sexual orientation"

 Of course in the previous Administration the interpretation of TITLE IX was exactly the opposite.  But at this point in time, as in now... legally, biologically female athletes are not, by law, having their "rights" infringed upon.  

 

 You don't need to do anything.  They are our government so unless you go sign some paperwork They will do what They want without your input.

 What I am outlining is the process used.
