I think killing someone and saying they were going to die anyway is a defense that will get you put in prison.
Floyd did live a lifestyle that prevented him from being able to live. It's not like the cop kneeling on his neck facilitated the entirety of the situation that ended Floyd's life, but the cop did contribute.
I've held down many, many, drug and alcohol compromised people in medical centers over the years (312 uses of force utilizing restraints in my first year, and I was part time) and kneeling on a neck has been done.
One thing you learn about that is it takes seconds, even with a guy on meth, to gain control when the majority of a human's weight is localized on another's neck with the opposing force being the floor. 9 minutes, for me, is unheard of.
So if a patient came in with heart disease, a brain bleed, cocaine, meth, cyanide and roofing tar in his blood, and I was filmed kneeling on his neck for 5 minutes and that patient died, I would be investigated and most likely prosecuted.
That's just the reality of the environment of public/private protection. I would never consider saying he was going to die anyway as my legal defense.
