I think you're right about the drain tube being "downstream" from the air filter element, as is the tube which runs from the engine to the top of the airbox. If memory serves, it's an emmisions control that routes crankcase vapors to the combustion chamber rather than to the atmosphere, similar in function to the EGR systems on automobiles.
I don't know about toxicity, however. The drainage would be a combination of oil mist, condensation, and combustion by-products.
