Baffle Removed From Stock Muffler

I just purchased a 2006 S40 with 6300 miles on it. The baffle has been removed from the stock muffler. Should I be concerned about this?

Of course you should. That will make it louder, and thus under Federal regulations, illegal for road use.

Since many bikes around here are very noisy I really didn't consider the noise. I was concerned about engine performance and reliability.

It needs richer jetting,but it might already have that,If doesn't backfire to much its ok.But anytime you get more power out of a motor it want last as long.

Is the header, where it's connected to the engine and starts to curve downward, gold colored or is it a nice shiny silver like the rest of the exhaust. With that mileage, if it's been running lean it'll show up.

The header pipe is not discolored so he must have made the necessary mods. don't have plates as yet so I have not checked for backfire. Thanks for the help! I guess if it's not making too much noise it should be ok.

Actually it depends on where you are about noise regulations. In New Mexico where I live there is no noise limit for bikes. I looked it up.

Took the bike to a local dealer to have a quick professional go over so I will have to check the carb when I get it back. I did find since my earlier postings that a K&N carb jet was installed on it.
