Looks like he has "rearward" controls set up.

I was riding along & pulled next to a guy on an M 50. At every stop, he dropped to the side, his right leg on the seat at the KNEE..Light goes green, he jumps up & gooses it & rides away,., I wanted to buy that dude a cup O coffee & visit,, but I didnt mess with him,,

BUT...

...what's the legal age in the US to ride how many cc's bike ?

In Italy it's 14 years old to ride a 50cc, 16 y.o. to ride a 125cc, and 18 to ride any sizecc. limited to 34hp.

You need to have at least two years' experience with a 34hp bike to qualify for the "unlimited" hp bike.

I can't really guess well at what his actual age is. The picture quality isn't quite good enough for that. However, I believe you're correct that this is actually an adult whose bodily proportions differ significantly from average.
