Started to town to check on a gate post for moms front gate after the storm the other day snapped it off.
Stopped at the end of my driveway and checked both ways then started to pull out.
Neighbor kid at the end of the gravel drive is flying down the road about 40 or so, got his head down and on the cell phone.
You guessed it. Lil bassturd T-boned me.
Spun the bike a good 180degrees around and throwed me off of it on my back.

Real pisser is he stayed on the cell phone. IM laying in the middle of the road takeing inventory, bikes down and leaking gas and he gets out still yapping on the cell phone and asks me if im hurt?
Im in the middle of a gravel road on my back after hes hit me and he asks if im hurt.
Then says look what you did to my car!
You never stopped!

This set me off a lil bit. I get up. Told him i stopped, he was driveing to fast, look at what HE did to my bike and to GET OFF THE GD CELL PHONE!!!

Got the bike up and started checking it over.
Got both turn signals on the left side, smashed in the belt cover and hit the frame, bent the he!! out of my left rear shock, bent my key, smashed in the left side cover, bent the he!! out of the front foot peg and bent the rear as well.
Chewed up the left end cap on the handlebars and messed up the mirror as well as a multitude of scratches.
Most likely need a new helmet as well. This one was worn less then 2 dozen times, was new.

I ended up with(so far) banged head, bruised left shoulder(maybe the bone) bruised left hip(maybe the bone, Hurts and swelling) wrenched my bad back and ribs and a tiny bit of road rash on the left hip and wrenched neck. See what else hurts in the morning.

He had been driveing a sensible speed or been OFF THE GD CELL PHONE it might of been avoided.
I didnt have time to do squat except hit the throttle a bit and try and throw my left leg out of the way. Only thing kept him from breaking it the way he hit me.
Said he was only doing 20 but his slide marks went for over 35 feet which equates to about 35. Which is to d@mn fast on what is basicly a loose gravel driveway.
He and his mom fly up and down the drive. So much so one of them lost control last fall and took out about 30 feet of fence for me. Almost hit one of the kids my neighbor babysits a couple weeks back to.

Chitty day that was starting to look better turned to total cr@p!
Guess the adjuster will be out tomorrow sometime. See what the damages are going to total up to and what he thinks of the bike.
Right here on the weekend to, sucks.
That and its my primary mode of transportation. >:(

Guess it will be a good time to look for some intruder shocks or maybe sportster shocks. Defintely going to have to find some pegs and a belt cover. That is if they dont total it on cosmetic damage or tweaked frame. :'(

I have put a bike back together after it getting punched pretty hard by a car, there is potentially damage to forks/triple tree, swing arm, etc.

Insist that the adjuster price new parts for everything -- they will price "rebuilt" if you let them.

If you do keep the bike and have some warpage issues, start a thread up in RSD and I'll share the tricks of bringing one back from cockeyed to fully ridable.

Just glad you were able to walk away and okay for the most part!  The damage to your bike, as bad as it sucks (and it does suck big time) can be fixed or replaced easier than life or limb.  I sure hope the kid gets what he deserves for being such a dumb@$$.  Take care and keep us posted!  :)

checked out.

Sorry about the accident, at least you kept your cool and
didn't do something to the kid that you could end up
having assault charges against you.
Ok so you need to rebuild your bike, it can be done and
many here have parts and the knowledge to help you..

But seriously, glad you aren't terribly hurt.  Sounds like some good massage therapy is in order for you.   ;)

Do you know what he got cited for then? Or if he even did get a citation?

Damages like that really SUCK!!! But hopefully you only have minor injuries yourself. The bike can always be repaired/replaced as needed.

1) Did anyone call the Police? If so, did they take pictures and file a report?

2) Witnesses of any kinf́d? Even if no witnesses, the dynamics of the accident can be obtained by analysis of the damaged items, i.e. if you were stationary, your parts are dented, but no "motion scratches" if you know what I mean.

3) You can get the police to verify he WAS on the phone by analyzing his registry, even if he deletes the entry from his incoming/outgoing registry the phone company still hase those records. If you cna prove he lied to the Police, "his A$$ is grass" !!!

Bikes are easier to repair or replace than you are so that is the happy part of the story.

they could possibly argue that you are at fault since you pulled out in front of him, even if he was speeding.
make sure you document document document,
pics of the skid marks, previous encounters, etc

First and foremost, I'm glad you're not hurt worse.

But really, shouldn't you have just waited for him to pass, especially since you said you know he and his mother drive fast on that lane?

I live in the country, and my drive comes out onto a 2 lane country road where the speed limit is 45 - that means that most cars are doing at least 50, or more, as they go past my house.

Whether in my car or on my bike, if I see a car approaching when I'm at the end of my driveway, I just wait and let them pass.

Wolfman, I hope everything works out to your satisfaction, and congratulations on not getting hurt too bad.  

Careful what you post online before the legal aspect of the accident is resolved.  It'd be very easy for that family (or their legal counsel) to note your bike make & model, go to the predominant website on said bike and find an accident description matching the one they were just involved in...don't give them any legal ammo.

Jerry, if i could of seen the lil hunk of fecal matter comeing i would of waited for him to pass.

Whats really sucks is ive driven everything from enduro bikes to loaded semis for 35 years in 8 states and never even had a fender bender. I was kind of proud of that.

No im not posting pertinate details online untill its settled. Im not stupid.

Necks sore as hell, left hip and left shoulder.

I admire your restraint. If it was me he hit while talking on his cell, he would need an operation to have it removed from as far up his rectum as I could shove & kick it!!!! I've warned several people that I've had close calls with & it's funny how the color drains from their face when they realize I'm serious. >:(

Bill, go back and read my post again.
I COULD NOT see him untill after i was in the road.
I saw him on the cell phone just before he hit me. You know, things like that kinda stick in your mind. The last thing you see before flying through the fricking air!

I could of seen him speeding down the road i wouldnt of pulled out.
Remember this is rural where you cant see a mile down the road.
He wasnt speeding i wouldnt of got hit. Or if he had been off the D@MN CELL PHONE!!

RR13, id like to of 'touched him up' a bit but he looked like he was 18...maybe. Just what i need a rep for beating the he!! out of a school kid. Wouldnt of done my cause any good either.
Dont get me wrong, i was MAD! Folks that know me would of been running for the hills. This kid couldnt shut his mouth or stay off his cell phone though.
I just kept reminding myself he was a kid and it would go against any claim i tried to make. Not worth the satisfaction of takeing a pound or two of flesh.

Is there a law in Missouri about driving with cellphones?

Not sure if every state has the laws against it yet.

Following a Suburban yesterday, I saw it cross the lines into the oncoming lane 3 times in as many miles, & let the R/ side tires go off the road & into the grass twice,, Came to a stop where I was turning left, she was turning right, I dropped the window & gestured for her to do the same,, My wife beside me, I asked the woman,

"You okay, Hon?"
She looked puzzled, asked why??

I explained Id seen her in the wrong lane 3 times & offroad twice in the last few minutes,, are you okay?

She said
I was on the phone
as she rolled the window up..

Wolf, I know you're right but you know how some things are a 'trigger' to bad behavior. I'm not sure I could contain myself in that situation.

And I know exactly what you mean about seeing details in a split second. When I raced I would often amaze my wife, daughter, & friends by telling them about something I saw in the stands during a race. It wasn't that I was trying, it's just that in the moment time seems to slow down around me. The first time I had it happen I was 14 & sliding on my butt towards an old lady who backed out in front of me. Seemed like that slide took FOREVER! That's also when I made up my mind to NEVER reliquish control by laying the bike down to 'avoid' an accident. Kind of defeats the purpose & there are no consequences for the person causing the incident. Now the time warp seems to occur in almost every emergency situation, which is a good thing because it gives me a better chance to react.

JOG, yesterday about 2:20 PM, there was a single vehicle wreck where a Mitsubishi Montero with 2 adults & 8 children left the highway, hit a culvert & rolled, resulting in the deaths of a 3 & 9 year old so far. I don't know what the driver was doing at the time but I would bet distraction of some sort played a part in it. At  least one who died wasn't wearing a seatbelt (7 pass. vehicle). But the adults were wearing their belts! This happened on St. Hwy. 361 which runs STRAIGHT down the island for about 18 miles & has a full lane shoulder on both sides.

THE IDIOTS ARE OUT THERE & THEY WILL KILL THEMSELVES & YOU GIVEN THE CHANCE!!!

How mankind has managed to survive the dangers the world throws at us & the goofy stuff we do is amazing to me.. I know how many times I shoulda been dead,, & its more than 1 or 2..

Yeah funny how time slows and some things you remember in infinite detail. Some of them you'd like to forget.
Ive come to really hate cell phones(state bull said they hate em to...lol), they have put me in danger probably at least once a ride.
Now that schools stated again it will get worse. Obviously.

Mo has a no texting law for kids under 21, thats pretty much it. Id LOVE to see a full ban on em in a moveing vehicle.
They have been trying to ban them but so far the soccer moms have won out and kept em legal.

Wouldn't make any difference- there is a full ban on them here and people just ignore the law. Cops have better things to do than bust people for talking on the phone while driving (this from a cop LOL). :-?

You'r yapping on a cell your just as impaired as if you've been drinking far as im concerned.

Same day i got hit another rider got hit here. Took the whole front end off his bike. Kid on a cell phone
Now if i could just get a straight answer as to if i can start fixing my bike id be happy.

Speaking of fricken cagers....  Riding home from dinner last night, I come up behind a little slow moving car.  I'm thinking its a little old man, so I back off a little.  Then I feel a shower!  He had turned on his windshield washer and was splattering me.  I let off a little more and waved my hand.  A few feet later, he puts on his left blinker, moves into the left lane to make a turn, so I pulled up beside him, looked at him and said "thanks for the shower"....  It was a middle-aged dude.  I thought what an a$$hole.  I guess now it was pretty funny, but just another example of people who don't think twice about motorcycles.

Here is a no cell phone law while driving. However it doesn't
seem to matter to most.
What they didn't do when they made the law was, not have
it effect your insurance. Just a flat fine fee.
I do think the fee needs to be higher and have it effect
your auto insurance rates.
You have to at times hit their pocket books or wallets
to get their attention.
Also parents riding around on cell phone, with children
in the auto, great teaching skills.. kim

Who's going to enforce it? Around here the cops are on their cell phones as much as any other driver. Every time I see a cop drive past, they are on the cell phone. :-?

Im still waiting to get a straight answer from the insurance company myself. Pretty much feel like i got the run around friday and not a word since.
So i get to raise a lil he!! tomorrow to try and see whats up.
I get the ok to work on it and get the parts i can probably be on the road again in one or two days. Just a waiting game right now.

Wow Wolfman, you can't seem to catch a break. Glad you're still upright and functioning. Hope everything turns out all right. As for the kid not learning anything,...well in a younger day I had a down-the-road neighbor that was known to keep bb pistols in his trucks and such for popping varmints he came across. You'd be surprised how much they imitate flying gravel and the chips they leave in cars paint jobs. I'm told they make a heck of a sound when they hit too.
