is it just my bike or is this a stock flaw?
After filling up the bike even if i dont fill to the top and leave plenty of room some time or another the gas will leak all down my tank .. usually in my first right lean or turn after filling up....

whats the fix?
I had a vw beetle rubber gromet for the gas cap that fits it and tried using it and even looks good but still doesnt hold back the gas coming out..

That's normal,...  You are overfilling.
Fill up to the end of the tube with the bike in the upright position.  
Gas expands in the heat and it needs this much room, especially in the hot summer.

Also, don't let the bike lay on it's side.... it will leak then, as I unfortunatly found out :P

On my bike (see signature), gas will leak from the cap if I accelerate briskly from a stop within a few blocks of filling up.

I was having that problem when I filled my S40. I usually fill it, with the bike on the sidestand, to the bottom of the filler neck. I try to make sure to fill so part of the neck is in the fuel, and part is out. If I then replace the filler cap I usually get some fuel coming out. My solution has been to raise the bike upright and let the tank "burp" before I replace the filler cap. So far, it seems to be working.

 I always do it on the side stand as slow as it will go the last couple of cups,gas never comes up or leaks.

Try a new gas cap.
